Welcome to KomplyDox (“KomplyDox”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern access to and use of the KomplyDox platform, website, mobile applications and related services (“Services”).

By accessing or using KomplyDox, you agree to these Terms.

1. About KomplyDox

KomplyDox is a workforce compliance and operational management platform designed to assist businesses with:

  • onboarding and inductions
  • toolbox talks
  • contractor administration
  • operational workflows
  • incident reporting
  • inspections
  • invoice workflows
  • operational reporting and exports

KomplyDox provides administrative and operational tools only and does not provide legal, accounting, employment or compliance advice.

2. Eligibility

You must be at least 18 years old and authorised to act on behalf of a business or organisation to use KomplyDox.

By using the Services, you confirm that:

  • information provided is accurate
  • you are authorised to use the platform
  • you will comply with applicable laws and regulations

3. User Accounts

Users are responsible for:

  • maintaining account security
  • protecting passwords and login credentials
  • restricting unauthorised access
  • ensuring invited users are appropriately authorised

Users are responsible for all activity occurring under their accounts.

4. Acceptable Use

Users must not:

  • use the Services unlawfully
  • upload false, misleading or unlawful content
  • interfere with platform security or functionality
  • attempt unauthorised access to systems or data
  • upload malicious software or harmful code
  • misuse operational or reporting tools
  • infringe intellectual property rights

KomplyDox may suspend or terminate accounts for misuse or breach of these Terms.

5. User Content & Uploaded Information

Users retain responsibility for information uploaded to KomplyDox, including:

  • operational records
  • agreements
  • incident reports
  • invoices
  • contractor information
  • uploaded documents

Users are responsible for ensuring:

  • they have authority to upload information
  • uploaded content complies with applicable laws
  • information is accurate and lawful

KomplyDox does not independently verify uploaded information.

6. Compliance Responsibility

KomplyDox assists businesses with operational and compliance workflows but does not guarantee legal or regulatory compliance.

Businesses remain solely responsible for:

  • workplace compliance
  • employment obligations
  • contractor management
  • licensing obligations
  • safety procedures
  • document retention requirements

Use of KomplyDox does not replace professional legal, accounting or compliance advice.

7. User Responsibility for Compliance

KomplyDox provides compliance tools, templates, training modules, forms, checklists, policies and document management functionality to assist businesses with workplace compliance. KomplyDox does not guarantee that its templates, AI-generated content, training materials or document library satisfy all legal, regulatory, contractual or industry-specific obligations applicable to a customer.

Each customer is solely responsible for:

  • determining its own compliance requirements
  • ensuring all required policies, procedures, licences, permits, inductions and training are implemented
  • reviewing and approving all documents before use
  • obtaining professional legal, HR, WHS or compliance advice where required

8. AI-Generated Content

KomplyDox may provide AI-generated documents including policies, procedures, toolbox talks, inductions, risk assessments, SWMS, checklists and training materials. AI-generated content is provided as a drafting and productivity tool only.

Customers must review, verify and approve all AI-generated content before relying upon it for compliance purposes. KomplyDox accepts no responsibility for errors, omissions or inaccuracies contained within AI-generated content.

9. Document Library

The KomplyDox document library is intended as a starting point for compliance management. Industry requirements vary between jurisdictions, industries, customers and workplaces.

Customers are responsible for determining whether additional documents, procedures, licences, permits or records are required.

10. Data Backup Responsibility

KomplyDox maintains systems intended to securely store customer records. However, customers are responsible for maintaining their own copies and backups of important compliance records, training records, licences, acknowledgements and business documentation.

Customers should not rely solely on KomplyDox as their only document storage location.

11. No Legal or Professional Advice

Information provided through KomplyDox does not constitute legal advice, workplace relations advice, HR advice, WHS advice or professional consulting services. Customers should seek independent professional advice where required.

12. Payments & Subscriptions

Certain features may require paid subscriptions or add-ons.

Subscription pricing, features and limits may change from time to time.

Users authorise KomplyDox and its payment providers to process recurring subscription payments where applicable.

Failure to pay subscription fees may result in:

  • feature limitations
  • suspension of services
  • account restrictions

Unless otherwise stated:

  • subscription fees are non-refundable
  • taxes and GST may apply

13. Enterprise Features

Enterprise-only features may include:

  • operational reporting tools
  • bulk payment exports
  • ABA payment file generation
  • higher operational limits
  • increased storage capacity

KomplyDox generates operational payment files only and does not process payments directly.

All financial approvals and payment processing remain the responsibility of users and their financial institutions.

14. Availability of Services

We aim to provide reliable Services but do not guarantee uninterrupted availability.

KomplyDox may:

  • modify features
  • perform maintenance
  • update systems
  • suspend functionality
  • discontinue features

without prior notice where reasonably necessary.

15. Third-Party Services

KomplyDox may integrate with or rely on third-party providers including:

  • payment processors
  • cloud hosting providers
  • analytics providers
  • communication services
  • banking export systems

We are not responsible for third-party services or external platforms.

16. Limitation of Liability

To the maximum extent permitted by law:

KomplyDox is provided “as is” and “as available” without warranties of any kind.

We are not liable for:

  • indirect or consequential losses
  • business interruption
  • data loss
  • lost profits
  • operational disruptions
  • regulatory penalties
  • contractual breaches
  • compliance failures
  • employment disputes
  • safety incidents
  • loss of licences or certifications
  • reliance on AI-generated content or template documents without adequate review
  • incorrect user-entered information
  • unauthorised access caused by user negligence

Users remain responsible for maintaining backups and appropriate operational procedures.

17. Indemnity

Users agree to indemnify and hold harmless KomplyDox, its owners, affiliates and service providers from claims, liabilities, damages or expenses arising from:

  • misuse of the Services
  • breach of these Terms
  • unlawful uploaded content
  • workplace or compliance disputes
  • unauthorised use of accounts

18. Intellectual Property

All KomplyDox branding, software, workflows, designs and platform content remain the property of KomplyDox unless otherwise stated.

Users may not:

  • copy
  • reverse engineer
  • resell
  • redistribute
  • reproduce the Services without permission

19. Privacy

Use of KomplyDox is also governed by our Privacy Policy.

Users acknowledge that information may be processed and stored in Australia, New Zealand or other jurisdictions.

20. Customer Acknowledgement

During onboarding, and by continuing to use the Services, customers acknowledge that:

  • they remain responsible for compliance
  • KomplyDox is a compliance management tool only
  • additional documents may be required
  • AI-generated content must be reviewed
  • independent backups should be maintained

21. Termination

Users may stop using the Services at any time.

KomplyDox may suspend or terminate access where:

  • Terms are breached
  • misuse occurs
  • payment obligations are not met
  • operational or security risks arise

22. Changes to Terms

We may update these Terms from time to time.

Updated Terms will be published within the platform or website with an updated effective date.

Continued use of KomplyDox after updates constitutes acceptance of revised Terms.

23. Governing Law

These Terms are governed by the laws of South Australia, Australia unless otherwise required by applicable consumer laws.
